Liability of Board Members of Polish LLC

We also provide debt collection in Poland based on  liabiility of board members of Polish limited liability company. Such a possibility is provided for in the Polish Commercial Companies Code in a situation where bailiff enforcement against the company proves ineffective. If the enforcement proceedings  against the Polish company proves ineffective, the members of the management board of such debtor company  are jointly and severally liable for its obligations. Only very specific premises may release the member of the management board from such liability ( e.g. if he proves that a bankruptcy petition has been filed in due time).
